Service of Process in Ventura and Los Angeles Counties...What is the true value of proper service?

Process Servers by Amstar Express…what should you look for in a process serving company?

The first thing you should be aware of when looking for experienced Professional Process Servers, is that choosing the right server can impact your case negatively if not handled correctly.

In a legal battle, the opposing party is looking for any weakness in your case that can be leveraged.  Make no mistake; the first place they’re going to look is whether or not all the rules have been followed to the letter with regard to how your legal documents were served by your Process Server.
 
These rules include certain time constraints, proper identification of the person or entity served, was the ‘capacity notice’ filled out correctly, was the proof of service accurate etc.. Therefore it is critical that when your choosing experienced Process Server professionals, that the focus is more on expertise than price alone!

Registered Process Servers…Registered and Trained?
Many people erroneously assume that registered process servers are nothing more than a legal document messenger, but the technical nature of the job and the costly ramifications of improper service, makes your decision of which Process Servers you choose, a very important one.

A common misconception is that if a person is a “Registered Process Server”, that this person must know the rules.  Unfortunately this is not true..  The State only requires is that a person pays certain fees, obtains a bond, submits fingerprints and receives the blessings of the Department of Justice because they have not been convicted of a felony. 

The state does NOT require that the person registering has any training or background and there are no tests given for proficiency!   Again, choosing qualified Process Server professional becomes a bit more difficult.

So just how do you make the right choice for a QUALIFIED Process Server?

Ask how long the person or company has been in operation.  When asking for a price, see if they ask particular questions such as type of documents your serving, when your court date is if any?   Ask if witness fees are required?  If you have a small claims service, do they ask what county the action was filed in and what county the defendant lives in.  If it is an unlawful detainer, do they ask how many persons reside and the location?  
These are just a few of the questions you can ask and most people can tell when they’re talking to an experienced person.
